LEGAL ASPECTS OF
CROSS-BORDER POSTING
OF WORKERS
The temporary work in EU countries is possible on the basis of freedom to provide services for entrepreneurs in other Member States.
The legal basis for the posting of workers is Directive 96/71/EC of the European Parliament and of the Council of 16 December 1996 on the posting of workers in the context of the provision of services and Directive 2014/67/EU of the European Parliament and of the Council of 15 May 2014 on implementing Directive 96/71/EC on the posting of workers in the framework of the provision of services and amending Regulation (EU) No 1024/2012 on administrative cooperation using the Internal Market Information System.
Member States are obliged to treat posted workers equally; this applies to e.g. the following areas:
- Time of work and rest,
- Number of paid vacation days per year,
- Minimum wage,
- Any other salary supplements,
- Occupational health and safety,
- Equal treatment of women and men and other anti-discrimination provisions.
Social and health insurance contributions are paid by employees in the country of employment, but taxes are paid in the host country from day one.
The company employing the employee applies for A1 forms for its employees, which confirm the validity of the social security system of the country where the employee is employed.
